Terms and Conditions of Sale and Purchase

1. General provisions

1.1. These Terms and Conditions of the online store (hereinafter – the Terms) constitute a legally binding document for the Buyer and the Seller (hereinafter – the Seller), setting out the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend or supplement these Terms at any time. The Buyer shall be informed about any changes to the Terms on the online store website.

2. Conclusion of the sale and purchase agreement

2.1. A sale and purchase agreement between the Buyer and the Seller shall be deemed concluded when the Buyer forms and submits an order for goods in the online store after having familiarized themselves with these Terms.

3. Seller’s rights

3.1. In the event of important circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability or security of the online store or breaches their obligations, the Seller has the right to restrict or suspend the Buyer’s access to the online store without prior warning.

4. Seller’s obligations

4.1. The Seller undertakes to enable the Buyer to use the services of the online store in accordance with these Terms.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method selected by the Buyer and in accordance with these Terms.
4.3. If, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the online store, the Seller has the right to terminate the sale and purchase agreement after informing the Buyer. The Seller may offer an analogous product. If the Buyer refuses, the Seller undertakes to refund the paid amount within 3 working days.
4.4. If the Buyer exercises the right provided in Clause 5.2 of these Terms, the Seller undertakes to refund the Buyer the paid amount within 5 (five) working days from the date of receipt of the returned goods.
4.5. The Seller may withhold the refund until the goods are returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller, whichever occurs first.

5. Buyer’s rights

5.1. The Buyer has the right to purchase goods in the online store in accordance with these Terms.
5.2. The Buyer has the right to withdraw from the sale and purchase agreement concluded in the online store by notifying the Seller in writing no later than within 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The right specified in Clause 5.2 may be exercised only if the goods have not been damaged, their appearance has not substantially changed, and they have not been used.

6. Buyer’s obligations

6.1. The Buyer must pay for the purchased goods and accept them in accordance with the procedure set out in these Terms.
6.2. If the Buyer refuses to accept the goods at the time of delivery without valid reasons, the Buyer must cover the return costs upon the Seller’s request.
6.3. Upon delivery of the goods, the Buyer must inspect the condition of the shipment and the goods together with the Seller or the person delivering the parcel.
6.4. By using the online store, the Buyer confirms their agreement with these Terms and undertakes to comply with them.

7. Prices of goods

7.1. Prices of goods in the online store are indicated in euros. After confirming the order, a delivery fee is added to the total amount.

8. Ordering and payment for goods

8.1. After visiting the online store, the Buyer selects the desired goods and adds them to the shopping cart. After forming the shopping cart, the Buyer enters the personal data necessary for order fulfillment: name, surname, delivery address, phone number and additional information relevant for delivery. The Buyer confirms that they have read these Terms and confirms the order.
8.2. Payments can be made using electronic banking services of Swedbank, SEB, Luminor, Citadele and Šiaulių bankas, as well as Visa / MasterCard payment cards. Payments are made in euros. Payments are processed via the MakeCommerce.lt payment platform.

9. Delivery of goods

9.1. When ordering goods, the Buyer must specify an accurate delivery address.
9.2. The Buyer must accept the goods personally. If the Buyer cannot accept the goods personally but the goods are delivered to the address specified by the Buyer, the Buyer shall not have the right to raise claims regarding delivery to an improper person.
9.3. The Seller delivers goods in accordance with the timeframes indicated in the product descriptions.
9.4. The characteristics of all goods are indicated in the description attached to each product. The Seller is not responsible for the fact that the color, shape or other parameters of goods in the online store may not correspond to the actual size, shape or color due to the characteristics of the Buyer’s monitor.
9.5. If the Buyer withdraws from the sale and purchase agreement, all amounts paid by the Buyer, including delivery costs, shall be refunded.

10. Return of goods

10.1. Quality goods may be returned within 14 days from the date of receipt. Defects of defective goods shall be eliminated, defective goods replaced or refunded in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. The following conditions must be complied with when returning goods:
10.2.1. The returned goods must be in their original, tidy packaging (this does not apply when returning defective goods);
10.2.2. The goods must not be damaged by the Buyer;
10.2.3. The goods must be unused and must not have lost their commercial appearance (labels intact, protective films not removed, etc.) – this does not apply when returning defective goods;
10.2.4. The returned goods must be of the same composition as received by the Buyer (this does not apply when returning defective goods);
10.2.5. The Seller has the right to refuse to accept returned goods if return conditions have not been complied with;
10.2.6. Goods must be returned in the manner specified by the Seller within 14 (fourteen) days from the date of receipt (this does not apply to defective goods – in such cases, returns are carried out within the statutory warranty period).
10.3. Return and exchange of goods of suitable quality shall be carried out in accordance with Article 6.22810(1) of the Civil Code of the Republic of Lithuania.
10.4. Money for goods accepted by the Buyer but later refused shall be refunded to the Buyer’s account no later than within 5 (five) days from the date the goods are returned to the Seller, unless otherwise agreed between the Seller and the Buyer.

11. Final provisions

11.1. These Terms are drawn up in accordance with the legal acts of the Republic of Lithuania.
11.2. These Terms and the legal relations between the Parties shall be governed by and interpreted in accordance with the laws of the Republic of Lithuania.
11.3. All disagreements arising from the implementation of these Terms shall be resolved through negotiations. If no agreement is reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
11.4. The Parties shall be released from their obligations under these Terms if they are unable to fulfill them due to unforeseen circumstances beyond the control of the Parties (force majeure).
